A HC bench comprising Justice Md Nazrul Islam Talukder and Justice Kazi Md Ejarul Haque Akondo came up with the order on Wednesday after hearing a petition filed buy the Anti-Corruption Commission (ACC) against the lower court order.

The court also asked Samrat to surrender before trial court within seven days. 

The lawyer of Samrat has been asked to file fresh bail petition with the trial court with proper medical report.

Samrat has sought bail in medical ground but his lawyer did not submit medical grounds. However, his counsel submitted a statement of the BSMMU doctors saying he is sick and he needs a treatment which is not well established in Bangladesh.

The court observed that the lower court judge granted bail on medical ground without medical report. It is like putting cart before the horse.

The court asked the lawyer of Samrat to submit formal report of the medical board of BSMMU on June 9.

Advocate Mansurul Haque Chowdhury appeared for Samrat and Khurshid Alam Khan for ACC.

On May 16, the ACC filed the petition to crap the lower court order in a graft case. 

Samrat was released from jail on May 11 following the lower court decision.

On May 11, Judge Al Asad Md Asifuzzaman of Special Judge Court 6 passed an order granting bail to Samrat in the case.

The lower court imposed conditions that Samrat would not be allowed to leave the country without the permission, he would submit his passport and health reports on stipulated date.
